General terms and conditions

1. Scope

The following T&Cs apply to all orders placed via our online shop. Our online shop is for consumers only.

2. Contractual partner, formation of contract

The purchase contract is concluded with Watch House, Zafer Yigitoglu.

The display of products within the online shop constitutes a binding offer on our part to enter into a contract vis-à-vis the items. You may place our products in your basket without obligation and amend your entries at any time prior to submitting a binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in your basket. Once you have sent your order you will immediately receive a confirmation via e-mail.

3. Contract language, saving of the contract text
The languages available for concluding the contract are German and English.

We save the text of the contract and forward the order data and our T&Cs to you by e-mail. You may also view the text of the contract in our customer login area.

4. Delivery conditions

Delivery costs may be added to the product prices displayed. Further information on delivery costs, if applicable, are explained within individual product offers.

You are entitled to collect your order from Watch House - Zafer Yigitoglu, Naumannstraße 4 , 10829 Berlin, Deutschland during the following hours of business: Montag bis Freitag von 10:00 Uhr bis 17:00 Uhr.

5. Payment

The following payment methods are basically available in our online shop:

Advance payment
If you select advance payment we provide you with our bank details in a separate e-mail and deliver the goods on receipt of funds.

PayPal, PayPal Express
During the ordering process you will be forwarded to PayPal's online website. To pay the invoice amount via PayPal, you must be registered there or register first, identify yourself with your access data and confirm the payment instructions to us. After submitting your order in the shop we instruct PayPal to initiate the payment transaction.
Directly afterwards, the payment transaction is carried out automatically by PayPal. You will receive additional information during the ordering process.
 

PayPal Plus
Within the context of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be forwarded to PayPal's online website. You may enter your payment details there and confirm the use of your data by PayPal and the payment instructions to PayPal.

If you have selected the PayPal payment type, in order to pay the invoice amount, you must be registered there or register first and identify yourself with your access data. The payment transaction will be carried out automatically by PayPal directly after confirmation of the payment instructions. You will receive additional information during the ordering process.

If you have selected the credit card payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. The payment transaction will be carried out by your credit card company upon request by PayPal and debited to your card, directly after confirmation of the payment instructions and after your identification as the legal cardholder. You will receive additional information during the ordering process.

If you have selected the direct debit payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. With the confirmation of the payment instructions, you are granting PayPal a direct debit mandate. PayPal will inform you separately about the date of the account debit in an advance notification (pre-notification). With the submission of the direct debit directly after confirmation of the payment instructions, PayPal will request its bank to initiate the payment transaction. The payment transaction is automatically carried out and your account is debited. You will receive additional information during the ordering process.

If you have selected the invoice payment type, in order to pay the invoice amount, you do not need to be registered with PayPal. After a successful address and creditworthiness check and placement of your order, we will assign our claim to PayPal. In this case, you may only pay to PayPal with a debt-discharging effect. For payment processing via PayPal – in addition to our GTC – the GTC and data protection policy of PayPal shall apply. Amazon Pay
During the ordering process you will be forwarded to the online Amazon website before completing the ordering process in our online shop. In order to process the ordering process via Amazon and pay the invoice amount, you must be registered there or register first and identify yourself with your access data. There, you may confirm the delivery address and payment method stored with Amazon and confirm the use of your data by Amazon and the payment instructions to us. After this, you will be returned to our online shop, where you may complete the ordering process.
Directly after the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive additional information during the ordering process.

Cash payment on collection
You pay the invoice amount in cash on collection.

6. Retention of title

The goods shall remain our property until full payment is made.

7. Damage during delivery

If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or transport insurer.

8. Warranty and guarantees

We are under a legal duty to supply products that are in conformity with this contract.
For consumers, statutory warranty rights governed by the law of the country where the consumer has his habitual residence apply. Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.

9. Liability

We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents

  • for injury to life, limb or health
  • for deliberate or grossly negligent breach of duty
  • for guarantee commitments, where agreed
  • towards consumer.

Except these cases, our civil law liability is limited to the foreseeable and direct damages at the time of contract conclusion.

11. Online dispute resolution
The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/.
In order to settle disputes arising from a contractual relationship with a consumer or from whether such a contractual relationship exists at all, we will participate in dispute settlement proceedings before a consumer dispute resolution body. Consumers can contact their national European Consumer Centre in this regard. Instructions on Withdrawal

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, have or has taken possession of the last goods. To exercise your right of withdrawal, you must inform us (Watch House, Naumannstrasse 4, 10829 Berlin, Germany Telephone: 030 6153636, E-mail: service@watchhouse.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, although this is not mandatory. You may also declare your withdrawal using the online withdrawal function “Withdraw from contract” provided on our website at https://watchhouse.de/Online-Widerrufsformular_1. There you can enter and submit electronically the information required to assign your withdrawal to your order. If you make use of this option, we will send you confirmation of receipt of such withdrawal without undue delay (e.g. by e-mail). To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us, or to Watch House, Naumannstrasse 4, 10829 Berlin, Germany, without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their condition, properties and functionality.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

PayPal Payment by Instalments and Purchase on Invoice

If you paid for or financed your order using PayPal Payment by Instalments or PayPal Purchase on Invoice and effectively withdraw from the purchase contract, the reversal of the payment will be carried out in accordance with the applicable PayPal terms and conditions. As a rule, we process reimbursements for payments made via PayPal through PayPal. Payments already made or amounts already collected by PayPal may be refunded by PayPal or offset against outstanding amounts in accordance with the PayPal terms and conditions. For questions regarding the specific payment processing, amounts already collected, outstanding claims, instalment plans or payment deadlines, please also contact PayPal.

Voluntary 30-Day Return Guarantee

In addition to your statutory right of withdrawal, we grant you a voluntary 30-day return guarantee for all purchases from receipt of the goods, unless different conditions are stated in the respective offer. The prerequisite is that the goods are returned within this period complete, undamaged, in their original condition, tried on only as they would be in a retail store, and in their original packaging. This guarantee does not apply to goods that have been made to customer specifications or are clearly tailored to personal needs. Your statutory right of withdrawal is not restricted in any way by this guarantee.

Free Returns from Germany

Free returns within Germany are a voluntary service provided by Watch House and apply exclusively to orders placed directly through our own online shop watchhouse.de. In this case, we bear the return shipping costs for returns within Germany. This voluntary assumption of costs does not apply to purchases made via external sales platforms such as eBay or Amazon, unless expressly stated otherwise there. For purchases made via external sales platforms, the return conditions stated in the respective offer, in the order process and in the statutory withdrawal instructions apply.
